This document supplements Essential Nutrition's Privacy Policy and has been in effect since May 12, 2024.
This additional notice is required by Washington’s My Health My Data Act and Nevada’s Consumer Health Data
Privacy Law and applies only to personal information that may be considered "Consumer Health Data" under
these laws.
Consumer health data, as defined by these laws, refers to personal information that is linked or reasonably
linkable to a consumer and that identifies the past, present, or future physical or mental health status,
which may include information about medical conditions as well as non-medical information, such as biometric
data, information about the use of over-the-counter medications, or the use of health-related products, for
example.
Essential Nutrition will only collect health data in exceptional and limited cases, such as: the consumer's
physical or mental conditions; any treatment or diagnosis; allergic reactions to products; interest in
health-related products, for example.
These data will be used, only, when necessary, to provide customer service, enable communications, process
return or refund requests, and develop product improvements and maintain quality control. Under no
circumstances does Essential Nutrition sell consumers' health personal data to third parties.
Essential Nutrition does not sell our customers' personal information, including consumers' health data, to
third parties. Such data will only be disclosed or shared, as directed by you, for the purpose of providing
products and services, or as explained in this document.
Consumer health data may be shared, with due security and confidentiality, with our data processors, service
providers, and contractors who assist us. These processors may use the data only as permitted by our
contracts with them.
We may also disclose data as permitted by law, such as (i) with your consent, (ii) if necessary to protect
your vital interests, such as in the event of a medical emergency or natural disaster, (iii) to an acquiring
organization if we are involved in the sale or transfer of our business, (iv) as necessary to prevent,
detect, protect against, or respond to security incidents, identity theft, fraud, harassment, malicious or
deceptive activities, (v) as necessary to preserve the integrity or security of our systems, or (vi) to
investigate, report, or prosecute those responsible for any action that is illegal under applicable state or
federal law.
The source of health personal data collection will be during any customer or user service, through their
interactions with the products or through contact via targeted marketing.
Essential Nutrition respects your rights to know, access, correct, transfer, restrict the processing, and
delete your personal data. This includes the limited instances in which we process or collect consumer
health personal data in accordance with applicable privacy law. When consumers are asked to consent to the
processing of their personal data, they also have the right to withdraw consent at any time, as provided in
the Privacy Policy.
This Notice may be modified, altered, or replaced at any time and should be constantly checked for any
changes on our website. In the event of changes, we will update the date at the top of this
Notice.
